Terms of Service

1. Agreement to Terms

By accessing or using MerchForAll ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms apply to all visitors, users, creators, and buyers who access or use the Platform.

2. Description of Service

MerchForAll is a print-on-demand merchandise platform that enables creators to design, sell, and ship custom products without managing inventory. The Platform provides:

• Product design tools and a catalog of customizable products
• Branded storefronts for creators to showcase and sell their merchandise
• Order processing and fulfillment through our partner, Printful
• Secure payment processing through Stripe Connect
• Creator payouts and earnings management

3. Account Registration

To use certain features of the Platform, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

Each user is limited to one store per account. You must be at least 18 years old to create an account.

4. Creator Obligations

As a creator on MerchForAll, you represent and warrant that:

• You own or have the legal right to use all artwork, designs, and content you upload
• Your content does not infringe upon any third-party intellectual property rights
• Your products comply with all applicable laws and regulations
• You will not upload content that is defamatory, obscene, or otherwise objectionable
• You are responsible for the accuracy of your product descriptions and pricing

5. Buyer Terms

When purchasing products through MerchForAll:

• All payments are processed securely through Stripe
• Prices are displayed in USD and include the product cost and creator markup
• Shipping costs are calculated at checkout based on destination and product weight
• Orders are fulfilled by Printful and typically ship within 2-5 business days
• Refund and return policies are subject to Printful's fulfillment policies for print-on-demand products

Since products are custom-made on demand, returns are generally only accepted for defective or damaged items. Please contact us within 14 days of receiving a defective item.

6. Intellectual Property

Creators retain all ownership rights to their original artwork and designs. By uploading content to MerchForAll, you grant us a non-exclusive, worldwide license to use, display, and reproduce your content solely for the purpose of operating the Platform and fulfilling orders.

The MerchForAll name, logo, and all related branding are the property of MerchForAll. The Platform's software, design, and underlying technology are protected by intellectual property laws.

7. Payment Terms

MerchForAll uses Stripe Connect for payment processing and creator payouts. The payment structure is as follows:

• Creators set their own retail prices above the base product cost
• The platform retains the base product cost plus shipping to cover fulfillment
• Creators receive the difference between their retail price and the base cost
• Standard payment processing fees (2.9% + $0.30 per transaction) apply
• Payouts are processed through Stripe to the creator's connected bank account

8. Prohibited Content

The following types of content are strictly prohibited on MerchForAll:

• Content that infringes on copyrights, trademarks, or other intellectual property
• Hate speech, harassment, or content promoting violence
• Sexually explicit or pornographic material
• Content promoting illegal activities or substances
• Spam, misleading content, or fraudulent schemes
• Content that exploits or endangers minors

We reserve the right to remove any content and suspend or terminate accounts that violate these restrictions. See our Acceptable Use Policy for full details.

9. Termination

Either party may terminate this agreement at any time. Creators may close their store through the dashboard settings. MerchForAll may suspend or terminate accounts that violate these Terms.

Upon termination, any pending orders will be fulfilled, and outstanding payouts will be processed according to our standard payout schedule. Store data may be retained for a reasonable period to comply with legal obligations.

10. Disclaimers & Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MERCHFORALL DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MERCHFORALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance of the modified Terms.
